Kenneth Cloggie

Kenneth called to the Bar in 2020, after 25 years practice as a criminal defence solicitor and solicitor advocate. Since calling, he has been widely instructed in a variety of cases, including murder, firearms, drugs, robbery, fraud and sex crimes.

He has stepped in for senior counsel to cross-examine a vulnerable witness with an acquired brain injury, successfully argued 275 applications, citing Appeal Court authority and first instance decisions and argued objections on admissibility leading to dismissal of an indictment.

Kenneth has tutored in Criminal Court Advocacy at University of Edinburgh and has qualifications in forensic medicine and advanced advocacy.

HMA v SR 2020 – Sex case where objection to admissibility of conduct of JII lead to dismissal of indictment

HMA v NB 2021 – Instructed after eleven 275 applications had been refused. Drafted and lodged late a twelfth detailed application which lead to desertion of indictment following precognition of complainer on details in application

HMA v KT 2021 – Prepared legal basis for successful no case to answer submission on mutual corroboration

HMA v TH 2021 – Cross examination of brain injured complainer on commission. Application at trial for defence expert witness to give evidence remotely from outside UK to preserve trial, resulting in early acquittal
